Trial
Mack was initially defended by lawyers Scott Freeman of Reno and David Chesnoff of Las Vegas. Chesnoff has built a national reputation by representing celebrities including Martha Stewart and Britney Spears. Washoe County District Attorney resigned from his case because of a long-standing personal relationship with Darren Mack, and because he could be a witness. DA Deputy Head Robert Daskas and Assistant DA Christopher Lalli from Clark County Prosecutor's Office handled prosecution.
At the preliminary hearing on August 30, 2006, Mack was detained for trial. The defense attorney requests an evaluation of the mental competence ordered by the court. On September 11, prosecutors announced they would not seek the death penalty. Mack pleaded not guilty to charges on the indictment on September 13, and his trial was set for October 1, 2007. On October 4, 2006, lawyer Scott Freeman attempted to get Mack's assassination fee charged.
Following a previous decision in a criminal case, on October 13 Senior Judge J. Charles Thompson disqualified the entire Washoe County bench from all civil cases against Mack. The trial was moved to Las Vegas, and Clark County District Judge Douglas Herndon was appointed to the case.
On November 5, 2007, Mack pleaded guilty to first-degree murder and submitted Alford's plea to the murder trial, just as the trial began, in exchange for a lifetime prosecutor's recommendation in prison with parole available after 20 years. Judge is not bound by the recommendation of punishment. Mack said during the defense, "I understand now in my state of mind that shooting in court is not the proper form of political redress".
Mack attempted to withdraw his request, saying he was forced by Chesnoff and Freeman and that his signature was falsified. Judge Douglas Herndon rejected Mack's motion for retreat, filed by his new defense attorney, William Routsis. During his sentence, Routsis kept updating his request for Herndon to give Mack a new experiment.
Under the terms of the defense agreement, Herndon sentenced Mack for life to kill his wife. He also gave Mack a maximum sentence of 40 years, with parole after 16 years, for attempted murder of Judge Weller and a lethal weapon increase. His punishments in a row, causing Mack not to qualify for parole for at least 36 years. Another hearing about his argument is scheduled for April 2008.
On March 18, 2008, a Washoe County juror submitted a $ 590 million settlement over Mack in his wife's furious suit, Charla. $ 560 million was given to the couple's young daughter, Erika, with the rest to go to her real wife.
Appeal
Mack continues to appeal his belief (arguing that he pleaded guilty under pressure) and also appealed a $ 590 million civilian decision. Judge Weller has filed a personal injury lawsuit against Mack, seeking redress and punishment.
Mack's plea, based on the argument that a judge should allow him to withdraw his guilty plea, was heard by the Nevada Supreme Court in 2010, and denied.
In February 2012 Mack again raised the issue in a petition filed in the United States District Court.
Mack claims he has no money anymore.
